1 | The General Terms and Conditions of the company “deutschundmehr Sprachinstitut e.U.”, which is registered in the commercial register of the Regional Court for ZRS Graz “FN 438758 h “, are an integral part of all contracts concluded with DEUTSCH&MEHR (especially course registrations and bookings) in their current version. Deviating agreements are only effective insofar as they have been made in writing. |

3 | Binding course registrations and rebookings are only accepted in writing, online or in person at the office. |
4 | DEUTSCH&MEHR is committed to working with professionally competent teaching staff. Changes in the person of the lecturer(s) are possible at any time. |
5 | The total invoice amount is to be paid before the course starts. The course fee can be paid either in cash or by bank transfer. In the case of bank transfers DEUTSCH&MEHR will only pay the charges and fees incurred in Austria. Our account: Raiffeisenlandesbank Steiermark, 8010 Graz, IBAN: AT13380000000780 8710; SWIFT/BIC: RZSTAT2G. In case of a delay in payment and subsequent reminder DEUTSCH&MEHR will charge:Payment reminder: € 0,–. Reminder: € 7 Reminder: € 15 and reserves the right to charge interest on arrears in the amount of 5% p.m. of the course price. If the second written reminder is sent, all discounts and reductions that may have been granted to the course participant will be forfeited, so that he/she will owe the regular course fee plus reminder fees and interest on arrears. The proceedings are transferred to a collection agency. As with other course participants, it must be ensured that the full course fee is due from the first day of the course. Various funding agencies will only pay the course fee if the participant has attended at least 80% of the lessons. Otherwise, the participant:in must pay the full cost of the course him/herself and arrange for refinancing if necessary. A complaint about the courses offered by DEUTSCH&MEHR does not entitle the participant to claim back the course fee, except in case of substantial and obvious defects. |
6 | If the maximum number of participants of 15 persons is reached, DEUTSCH&MEHR reserves the right to reject registrations. The date of receipt of the course fee will be used to determine eligibility. The minimum number of participants varies and can be found on the homepage under the respective courses and projects. DEUTSCH&MEHR reserves the right to cancel courses without a minimum number of participants or for organizational reasons, or to change the schedule if the majority of participants agree. Those who have already registered will be informed of a course cancellation prior to the start of the course. Payments made will be refunded in this case. If the minimum number of participants of 6 persons is not reached, the course can still be held if the difference is paid by full-paying participants or the number of hours is reduced accordingly. There is no entitlement to compensation for any costs incurred. Individual lessons are available at any time upon request. The dates for individual lessons are set by the student in consultation with the respective language coach. Any changes in the schedule on the part of the course participant must be announced no later than 3 p.m. on the day before the course. Otherwise, the fee for the individual lesson must be charged. |
7 | Cancellations must always be made in writing. Cancellations between five and two weeks prior to the start of the course will be refunded in full; cancellations within the last two weeks prior to the start of the course will be charged €50 in administration fees. Cancellations received within 72 hours prior to the start of the course, as well as cancellations on the first day of the course or thereafter, will be required to pay the full course fee. In case of irregular attendance or premature termination by the participating person, there is no right to any refund or discount. Cancellation of a private lesson must be made up to 24h before the appointment, otherwise the booked units will be charged. |
8 | DEUTSCH&MEHR is not liable for items brought along, such as clothing, valuables, money or course materials. Any damage caused by a course participant (e.g. to the course premises) must be reimbursed by the party causing the damage. DEUTSCH&MEHR is not liable in this respect. |
9 | By registering for a course, the course participant agrees that his/her personal data may be processed and used by DEUTSCH&MEHR in connection with the courses offered and the operation of the courses (sending of electronic advertising via e-mail, SMS or phone calls). The same applies to cases in which interested parties disclose their personal data in order to obtain information, etc. requested by DEUTSCH&MEHR or in cases where interested parties have provided DEUTSCH&MEHR with their personal data in the context of competitions, festivals or other marketing events. DEUTSCH&MEHR guarantees, in accordance with the provisions of the Data Protection Act, the obligation to maintain data secrecy. With your registration you allow the publication of images in deutschundmehr advertising material on which you are recognizable. This authorization may be revoked in writing at any time. |
10 | DEUTSCH&MEHR is not responsible for issuing visas or residence permits. The participants are responsible for compliance with the respective valid passport, visa, foreign exchange and customs regulations. |
11 | The offsetting of both judicial and extrajudicial claims is excluded. |
12 | In the event that individual provisions of the Terms and Conditions should become invalid, this shall not affect the validity of the remaining provisions. Any ineffective provisions shall be replaced mutatis mutandis in such a way as is permissible in accordance with legal provisions. |
13 | Unless expressly agreed otherwise, Austrian law shall apply. The competent court (the relevant authority) in Graz is responsible for disputes. Program changes and printing errors reserved. The place of jurisdiction in all cases is Graz. |
